These Terms of Service ("Terms") applies to DeltaDrop, a product operated by Wescorp Digital Pty Ltd (ABN 96 693 984 879) ("we," "our," "us") and explains how we provide access to our HVAC Pressure Drop calculation tools, subscription services, and websites located at deltadrop.io and app.deltadrop.io ("Services" or “app”).

1. Acceptance of Terms

By creating an account, accessing, or using our Services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, please discontinue use of the Services.

2. Description of Service

DeltaDrop is a web-based HVAC Pressure Drop Calculator that helps users estimate pressure drops in ductwork systems. Calculations are based on industry standards as well as values from component suppliers.

3. Using DeltaDrop

You must create an account to use the Services. You are responsible for:

• Keeping your login credentials secure
• Providing accurate and complete information
• Using the results responsibly within your professional context
• Respecting all applicable laws and intellectual property rights

The Services are intended for trained professionals in HVAC or related industries.

4. Disclaimer of Accuracy & Warranty

Our tools are provided "as is" and "as available". While we aim for accurate results, calculations are estimates only. You should independently verify critical calculations before purchasing or installing equipment.

We are not liable for costs, damages, or consequences resulting from incorrect calculations, system errors, or misuse of the app.

5. NCC Compliance Checking Tool

DeltaDrop includes a feature designed to assist users in identifying potential areas of non-compliance with the National Construction Code (NCC) Volume One, Part J6 requirements for air conditioning and ventilation ductwork systems (the "Compliance Checker").

The Compliance Checker is provided as a preliminary assessment tool only. It does not constitute certification, approval, or verification of compliance with the NCC or any other applicable standard.

By using this feature, you acknowledge and agree that:

• The accuracy and completeness of any output depends entirely on the accuracy and completeness of the data entered by the user.
• The Compliance Checker may not reflect the most current version of the NCC or jurisdictional variations. You are responsible for confirming that you are referencing the correct and applicable version via the Australian Building Codes Board (ABCB).
• The Compliance Checker does not assess all NCC requirements. Certain provisions, including but not limited to fan efficiency, transfer duct pressure drop, and system-specific exemptions, must be assessed independently by the user.
• The output must not be relied upon as evidence of compliance for certification, regulatory approval, or construction purposes.
• You remain solely responsible for ensuring that any design, system, or installation complies with all applicable laws, codes, and standards.

To the maximum extent permitted by law, Wescorp Digital Pty Ltd disclaims all liability (including liability for negligence) for any loss, damage, cost, or expense arising from or in connection with the use of, or reliance on, the Compliance Checker.

6. Subscription & Payments

We currently offer subscription access only. All payments are processed securely via Stripe.

Refund Policy

All subscription payments are non-refundable. You may cancel at any time, but no refunds will be provided for any remaining time in your billing period. You will have access until the end of your current billing cycle.

7. Limitation of Liability

To the fullest extent permitted by Australian law, Wescorp Digital Pty Ltd is not liable for:

• Indirect, incidental, or consequential losses
• Loss of profits, equipment, or project costs
• Issues caused by calculation errors, downtime, or reliance on estimated results

Your sole remedy is to stop using the Service.

8. Intellectual Property

All content, software, and calculations created by Wescorp Digital Pty Ltd are our intellectual property. This includes the way the calculations are implemented, the software interface, and original content.

9. Third-Party Services

We use Stripe for payments. These providers may access some information necessary to perform their services.

10. Account Termination

We may suspend or terminate your account if you violate these Terms or misuse the Service. You may request deletion of your account at any time, which will not provide a refund.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service at our discretion, with or without cause. Upon termination, your right to use the Service will cease immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
